RULES AND REGULATIONS

 

 

1.                  Ways to Enter the Contest. 

No purchase is necessary to enter.  To enter the Contest, enter online via 915thebeat.com The Contest commences on Saturday May 17th 2008 and closes at  11:59pm  EST on Sunday May 25th 2008.  All entries that are incomplete, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Contest rules and regulations may be disqualified. 

 

2.                  Eligibility

The Contest is open to legal residents of Canada (except residents of Québec), who are 18 years of age or older at the time of entry who have a valid passport and any other travel documentation required for entry into the United States..  Employees, officers, and directors (including immediate family members and members of the same household) of SONY BMG MUSIC (CANADA) INC.  and Corus Entertainment Inc. c/o 915 The BEAT (the “Sponsors”) and their respective distributors, dealers, marketing representatives, printers, advertising or promotional agencies, or any other organization associated with the Contest are not eligible to participate. 

 

3.                  Prize

One grand prize is to be awarded consisting of roundtrip economy airfare for two (2) to New York, NY, U.S. departing from Toronto, Ontario, via Porter Airlines, one (1) nights hotel accommodation at The Time (based on one room, double occupancy), and two (2) VIP passes to see USHER perform on Good Morning America on Friday May 30th 2008 at Times Square,  (Approx. retail value $1,100.00).  The Prize winner and his or her accompanying guest must be able to travel at the times and dates as determined by the Sponsors in their sole discretion.  All transportation to and from the airport, ground transportation, departure tax, insurance, fuel charges, travel related fees and items of a personal nature, including but not limited to food, beverages, room service, wine and bar charges, gratuities and local and long distance telephone calls, are the sole responsibility of the grand prize winner and his/her accompanying guest. The guest of the Prize winner must be 18 years of age or older and must have a valid passport and any other documentation required to enter the United States in order to participate in the Prize.  The grand prize is collectively referred to as the “Prize” in these rules and regulations.   The Sponsors reserve the right to substitute a Prize in whole or in part for a prize of equal or greater value in the event that any component of a Prize is unavailable for any reason.  Prize must be accepted as awarded and no substitutions, except as identified above, will be made.  Prize may not be sold, transferred or assigned and are not convertible to cash.

 

4.                  The Draw

The winner of the Contest will be selected in a random drawing conducted by Corus Entertainment Inc. c/o 915 The BEAT of all eligible entries received by the Contest Closing Time.  The odds of winning depend on the number of eligible entries received.  The random drawing will take place at approximately 8:50am on Monday May 26th, 2008.  The Sponsors will attempt to notify the selected entrant by telephone within 2 days of the draw.  In order to be declared a winner, the selected entrant must unaided correctly answer a time-limited skill-testing question and, within 3 days, complete and return to Corus Entertainment Inc. c/o 915 The BEAT a contest eligibility and liability/publicity release confirming compliance with these rules and regulations, releasing the Sponsors and their respective directors, officers and agents from all liability and, except where prohibited by law, permitting the Sponsors to use the selected entrant’s name, address (city and province) and image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsors.  Selected entrants must also provide proof of identity (photocopy of Driver’s License, Passport or any other government-issued photo identification).  In the event that a selected entrant is not eligible for any reason, has not correctly answered the skill-testing question or cannot be contacted after two (2) business days of the first attempt to contact the selected entrant, such entrant shall be disqualified and the Sponsors shall have the right to select another entrant and the Sponsors shall be released and discharged from any liability or responsibility in this regard.  No correspondence will be made except with the selected entrant(s).  All entry forms submitted become the property of the Sponsors and will not be returned. 

 

5.                  General

By entering the Contest, entrants agree to abide by these rules and regulations, and further agree that the decisions of the Sponsors are final.  The Sponsors reserve the right at any time without prior notice to withdraw, cancel, terminate, amend, modify or suspend the Contest if for any reason in the opinion of the Sponsors, in their sole discretion, the Contest is not capable of operating as planned or if the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond their control.  The Sponsors reserve the right in their sole discretion to disqualify any individual they find to be tampering with the online entry process or the operation of the Contest or to be acting in violation of these rules or otherwise in disruptive manner with respect to the Contest.  CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.  The Sponsors also reserve the right to cancel this contest at any time because of any printing or other error.  The Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software (including on account of traffic congestion on the Internet or at any Web site) or any combination thereof.  The Sponsors shall not be liable for any errors or negligence that may arise or occur in connection with the Contest, including any injury or damage to the entrant’s or any other person’s computer related to or resulting from participation in or downloading of any materials relating to the Contest or any theft, destruction or unauthorized access to, or alteration of, entries submitted online.  The Sponsors are not liable for injuries, death, damages or losses of any kind resulting from acceptance or use of the Prize.  In the event of a dispute, entries submitted online will be deemed to have been made by the authorized account holder of the e-mail address submitted at time of entry.  "Authorized account holder" means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.

 

6.                  Privacy and Personal Information

The Sponsors will be collecting data about entrants through the Contest entry forms.  Any personal information will be handled in accordance with the privacy policy of the Sponsors.  By entering the Contest each entrant consents to the collection, use and distribution of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsors for the purposes of implementing, administering and fulfilling the Contest.  The Sponsors will not sell or transmit this information to third parties unless the entrant has specifically consented to same, the Sponsors believe in good faith that it is required by law, to their affiliates (provided that such affiliates and their agents and advisors and their respective employees are restricted from using the information for any other purpose other than as described in these rules and regulations), or to their respective agents for data processing purposes, their respective professional advisors and promotional and marketing agencies (provided that such agents, professional advisors and promotional and marketing agencies are restricted from using the information for any purpose other than as described in these rules and regulations).  Any inquiry concerning the personal information held by the Sponsors should be addressed to the Sponsors at #120-235 King St E, Kitchener, On, N2G 4N5.

 

9.Publicity of Winner’s Name

The name of the selected entrant winner will be announced live on 915 The BEAT during the Morning Show broadcast no later than 9:00 A.M. EST, on May 26, 2008.

 

7.                  Subject to Applicable Laws

This Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
